Creator agreement
This agreement is between you, the person or company that runs a community on bigfann (the "Creator"), and bigfann. It applies in addition to the Terms of use, the Privacy notice, the Community guidelines and the Refund and cancellation policy. You accept it when you create your first community.
1. Your role and ours
- You are the seller of record for everything sold in your communities and the publisher of everything you post. bigfann is a marketplace intermediary: it hosts your community, collects payments on your behalf, issues invoices in your name, holds and releases your money, and provides moderation and support tools.
- You must be 18 or older and, if you sell, resident in India with an Indian bank account, PAN and, where the law requires it, a GST registration.
- You may add team members (co-admins, moderators, content managers) with limited roles. You remain responsible for what they do in your community.
2. Verification (KYC)
- You may open a community and post from day one. Before money is paid out to you, you must complete verification: legal name, date of birth, PAN, an identity document, a selfie, and a bank account or UPI id in your name, checked by our verification partner. Verification is also required within 14 days of opening your first community, or earlier once you reach ₹10,000 in sales or 500 members, whichever comes first.
- Until you are verified you cannot put a price on a course, product, event or session and nobody can pay you; anything already listed stays visible but cannot be bought. Sales made where selling is permitted before verification are held until verification passes.
- If you publish content about securities, trading or investment advice, you must hold and display the registration the Securities and Exchange Board of India (SEBI) requires. bigfann shows your registration number on your posts and may suspend finance content that lacks it.
- If your verification is rejected, or your documents turn out to be false, your account may be closed and held money returned to buyers or handed to the authorities as the law requires.
3. Fees
bigfann charges a platform fee on each sale, deducted before payout. The fee depends on the sale type and on your plan (Free, or Pro at ₹999 per month, which renews automatically until you cancel), and is shown in the app before you list anything and on every sale:
- Plans and premium groups: 8% (Free) · 5% (Pro)
- Courses: 8% · 5%
- Market — physical and digital products: 5% · 3%
- Event tickets and trips: 6% · 4%
- One-to-one sessions: 8% · 5%
- Made to order (custom work): 10% · 7%, which includes 2% payment charges
- Priority messages and credits: 15%
- Tips: 10%
Payment-processing charges are included in these fees. On Made to order, the 2% payment charges are shown as part of the fee above, not added on top. Purchases made through the Apple App Store or Google Play carry the store's commission instead of Razorpay's, as shown in the app. Fees may change with 30 days' notice in the app; the fee in force when a sale is made is the fee applied to it. GST applies to bigfann's fee and is shown on the fee invoice bigfann issues to you.
4. Payouts
- Sales settle to your held balance and become available: 7 days after the sale for plans, courses, digital products, credits and tips; 7 days after delivery for physical goods; for events, half on the first day after the event and the rest 3 days after it ends; after the session for one-to-one bookings; and for Made to order, once the member accepts the work or it is accepted automatically.
- Available money is paid to your verified bank account or UPI id on the schedule shown in the app (weekly by default). Payouts are made by RazorpayX; bank charges, if any, are shown before you confirm.
- bigfann holds or reverses money while a refund, dispute, chargeback, return, or legal request is open, where fraud is suspected, or while verification is incomplete or lapsed. Refunds and chargebacks are deducted from your balance; if the balance is insufficient you must pay the difference within 15 days.
- You are responsible for the income tax and GST on what you sell. Your invoices to buyers carry your GSTIN where you have one; without one, bigfann cannot issue a tax invoice on your behalf and you must not claim GST from buyers.
5. What you sell, and how
- Describe every item honestly: what it is, what it includes, when it is delivered, and the refund rule. The rule you choose is shown to buyers before they pay and binds you.
- Deliver what was bought within the time stated. Physical goods must be dispatched within the time shown on the order; bigfann may refund an undispatched order after that time. Digital goods and courses must be available once paid for. Events and sessions must take place as advertised; if you cancel, every buyer is refunded in full, including deposits. Made to order work must be delivered by the agreed date; if you cancel paid work, the member is refunded in full. Shipping follows the Shipping and delivery policy.
- You must comply with the Consumer Protection (E-Commerce) Rules, 2020 (including grievance handling, country of origin and pricing disclosures where they apply), the Legal Metrology rules for packaged goods, the ASCI guidelines on influencer advertising (label sponsored content), and any licence your goods or advice require.
- Prohibited: anything the Terms of use or Community guidelines prohibit; investment advice without SEBI registration; gambling or betting; tobacco, alcohol, drugs, weapons, counterfeit goods; medical claims without qualification; adult content; and anything that infringes another's rights.
6. Your members' data
- You can see the name, photo, plan, purchases and activity of your members and the messages they send you. You never see their phone numbers. Exports carry name, plan, groups and spend only.
- You may use this data only to run your community and serve your members. You must not sell it, use it to contact members outside bigfann without their separate consent, or move it to another platform, and you must protect it. For this data you are a data fiduciary under the DPDP Act, 2023 in your own right.
- When a member leaves or deletes their account, stop using their data except as the law requires.
7. Content and licence
- You own what you publish. You grant bigfann a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, transcode, watermark, display, moderate and deliver your content to your members and to people you invite, and to use your community's name, handle, image and public description to promote your community on bigfann and in bigfann's own marketing, for as long as your community exists.
- You must hold the rights to everything you publish, including music, images, video and third-party material, and you indemnify bigfann against claims that you did not.
- bigfann may hold, remove or limit content that breaks the law, the Terms of use, the Community guidelines or a lawful order, and will tell you why. You may appeal.
- Content protection (watermarks, screenshot reporting, device limits) is provided as-is; bigfann does not guarantee that content cannot be copied.
8. Moderation of your community
- You must set and enforce rules for your community consistent with the Community guidelines, review reports and held posts promptly, and answer appeals within 48 hours; unanswered appeals escalate to bigfann.
- You must remove members who break the rules and must not use moderation to silence complaints about what you sell.
9. Term and termination
- This agreement runs while you have a community on bigfann. You may archive or delete your communities and close your creator account at any time; running subscriptions end at the end of their paid period and members are told.
- bigfann may suspend or terminate your creator account for breach of this agreement, the Terms of use, the Community guidelines or the law, for failed or fraudulent verification, for repeated unresolved disputes, or where required by a lawful order. Serious breaches end the account immediately; others come with a warning and a chance to fix them.
- On termination, held money is paid out once open refunds, disputes and chargebacks are resolved, less amounts owed to bigfann or to buyers, and no later than 90 days after the last open matter closes. Records the law requires are retained as the Privacy notice describes.
10. Liability and indemnity
- You indemnify bigfann against claims, losses and costs arising from what you sell or publish, from your breach of this agreement or the law, and from your use of members' data.
- bigfann's liability to you is limited as the Terms of use state: to the platform fees you paid in the twelve months before the claim, and never for indirect or consequential loss, to the extent the law allows.
11. Changes, law and contact
- bigfann may change this agreement with 30 days' notice in the app; continuing to sell after that is acceptance. Fee changes follow section 3.
- Indian law governs; courts at Bhubaneswar, Odisha have exclusive jurisdiction. Disputes go first to the grievance officer.
